The Board does not permit the installation of satellite dishes. They deface the building through the installation process, they are an eyesore that the Board does not want to encourage, and they create a hazard (they could fall from their clamps). Installation of a satellite dish is a serious violation of the Proprietary Lease.
Posted by I LOVE SATELLITE TV, 26 Sep 2003 at 1:44 AM: PROHIBITING OR IMPAIRING SATELLITE DISH INSTALLATION IS PROHIBITED ACCORDING TO FCC RULES! YOUR HOUSE RULES CANNOT CONTRADICT FEDERAL LAWS, REGARDLESS OF “THE EYESORE” THE DISHES CREATE. IF THE TENANT HAS A BALCONY FOR THEIR EXCLUSIVE USE, THEY CAN INSTALL A DISH USING A PORTABLE TRIPOD, SINCE MOUNTING ON THE RAILING IS A SAFETY HAZARD. I HAVE FOUGHT THE BOARD OF MY COOP ON THIS MATTER AND I HAVE HAD THEM REMOVE THIS ILLEGAL RESTRICTION FROM THE HOUSE RULES. PROHIBITING THE INSTALLATION OF A SATELLITE DISH NOT ONLY VIOLATES FCC RULES, IT PROMOTES A MONOPOLY FOR THE CABLE COMPANY WITHIN THE BUILDING, SINCE THEY ARE THE PROVIDING CABLE SERVICE. AS A CONSUMER, ONE SHOULD BE FREE IN CHOOSING THEIR TV PROGRAMMING PROVIDER. BY RESTRICTING SATELLITE DISH INSTALLATION, THE MANAGING AGENCY IS RISKING A LAWSUIT IN WHICH THEY WILL LOSE AND PAY FINES FOR VIOLATING FCC RULES.
Posted by Webmaster, 27 Sep 2003 at 1:38 PM: Dear “I Love Satellite TV”: Honey, our buildings do not have “balconies for [tenants’] exclusive use.” In fact, none of the areas outside of the apartments are for anyone’s exclusive use: they’re common areas. So everything you said is irrelevant to our co-op.
Posted by I Love Satellite Too!!, 30 Jan 2004 at 5:37 AM: You can not prohibit installation of satellite dishes on exclusive use areas like inside the apartment through a window. The FCC protects this right making this entry in the co-op handbook unenforcable in such an installation.
Posted by Webmaster, 30 Jan 2004 at 8:12 AM: Honeys, Are you logically impaired? Obviously, the entry is referring to the installation of satellite dishes using clamps to attach them to the outside walls and other public spaces of the building. Our buildings have no balconies, so the only place that they could be installed is either on the outside wall or inside an apartment. Inside an apartment there’s no reason why you can’t install a satellite dish. Outside, however, is another matter entirely, and the co-op has every right to prohibit such an installation, and it’s enforceable because it’s part of the proprietary lease that all residents must abide by.
